LEGAL
Terms of Service
Effective August 10, 2026
These Terms of Service describe the conditions that apply when you request, purchase, schedule, or receive lighting design, installation, maintenance, or repair services from BrightSeason Lighting Co.
Estimates and Scope
Estimates are based on the information available at the time and remain subject to site conditions, product availability, design changes, permitting needs, and any written expiration date. The approved estimate, proposal, or work order defines the project scope.
Scheduling and Access
Scheduling is subject to weather, product availability, crew availability, property access, and other conditions beyond our reasonable control. Customers must provide safe and timely access to the property, electrical sources, controls, and agreed work areas.
Payments
Payment amounts and due dates are stated in the applicable estimate, invoice, or agreement. Deposits may be required before materials are ordered or work is scheduled. Late or failed payments may delay service and may be subject to lawful collection costs or fees stated in the agreement.
Changes and Cancellations
Requested changes may affect pricing and timing and should be approved in writing. Cancellations may be subject to charges for completed work, reserved labor, custom materials, restocking, permits, or other nonrecoverable costs, as allowed by the applicable agreement and law.
Customer Responsibilities
Customers are responsible for accurate property and ownership information, identifying known utilities and hazards, obtaining required approvals unless otherwise agreed, maintaining safe access, and following product and system instructions after installation.
Products, Workmanship, and Warranties
Any warranty coverage is limited to the written warranty provided with the estimate, agreement, manufacturer documentation, or final project materials. Warranty coverage may exclude misuse, alterations by others, power issues, landscaping damage, pests, extreme weather, normal wear, and maintenance not included in the agreement.
Maintenance and Repairs
Maintenance, seasonal adjustments, troubleshooting, replacement parts, and repair visits are included only when expressly stated. Additional visits or work outside the approved scope may require a separate estimate and scheduling.
Limitation of Liability
To the fullest extent permitted by law, BrightSeason Lighting Co. will not be liable for indirect, incidental, special, consequential, or punitive damages. Any direct liability relating to services will be limited as stated in the applicable written agreement and subject to rights that cannot lawfully be waived.
Indemnity
To the extent permitted by law, customers agree to be responsible for claims or losses arising from inaccurate information, unsafe property conditions not disclosed to us, unauthorized modifications, misuse of installed systems, or violation of these terms.
Governing Law
These terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any mandatory consumer protections and contractor requirements remain applicable.
